Judge OK's $10.5M Settlement In Kellogg Ads Suit

Law360, New York (October 14, 2010, 7:00 PM EDT) -- A federal judge has signed off on a $10.5 million class action settlement resolving false advertising claims against Kellogg Co. for claiming its Frosted Mini-Wheats cereals could improve kids' attentiveness.

Judge Irma E. Gonzalez of the U.S. District Court for the Southern District of California on Thursday granted preliminary approval to the settlement, which resolves the claims of a nationwide class of cereal purchasers.

Under the deal, Kellogg has agreed to pay $2.75 million to reimburse class members for the price of the cereal they purchased...
