Omni Can't Shake Auto Parts Fraud Action

Law360, New York (October 21, 2010, 6:55 PM EDT) -- A federal judge has refused to toss a putative consumer fraud class action against auto parts distributor Omni Solution Inc., rejecting the Illinois-based company's arguments that the federal court in Florida lacks jurisdiction.

Despite Omni's weak connection to the state, plaintiff Randall Rogers can pursue a class action under Florida Deceptive and Unfair Trade Practices Act, Judge Paul C. Huck of the U.S. District Court for the Southern District of Florida ruled Tuesday, denying Omni's motion to dismiss.
