Starbucks Tries To Close Lid On Hot Tea Suit in 2nd Circ.

Law360, New York (October 25, 2010, 5:09 PM EDT) -- Starbucks Corp. argued before an appeals court Monday against reviving a $3 million lawsuit asserting product liability claims for burns an elderly woman received when she spilled hot tea on herself while trying to remove a lid from a doubled-up paper cup.

The coffee chain’s lawyer George N. Tompkins argued before a panel in the U.S. Court of Appeals for the Second Circuit that a lower court judge was correct in finding that the plaintiff’s case was not strong enough to stand trial.
