Judge To Weigh Tax Scheme Losses In Ohle Sentencing

Law360, New York (October 27, 2010, 12:11 PM EDT) -- A federal judge has agreed to consider losses from an alleged tax shelter scheme in the sentencing of former Bank One Corp. executive John Ohle, even though Ohle’s convictions on counts of tax evasion and conspiracy didn’t include the losses.

Judge Jed Rakoff of the U.S. District Court for the Southern District of New York ruled Tuesday that Ohle’s Hedge Option Monetization of Economic Remainder tax shelters were clearly fraudulent — causing some $87.5 million in tax losses — and constituted “relevant conduct” that would factor...
