Verizon Beats TiVo Inequitable Conduct Claims

Law360, New York (October 29, 2010, 5:47 PM EDT) -- Verizon Communications Inc. has gained ground in its patent war with TiVo Inc. over digital video recording technology, defeating TiVo's claims that two patents Verizon asserted in infringement counterclaims were invalid for inequitable conduct.

Judge David Folsom of the U.S. District Court for the Eastern District of Texas on Thursday struck TiVo’s claims that two of the six patents Verizon asserted in response to TiVo’s own infringement allegations were no good because they were prosecuted fraudulently in the U.S. Patent and Trademark Office.
