Yellowstone Club's Ch. 11 Plan Back On The Table

Law360, New York (November 4, 2010, 2:45 PM EDT) -- A federal judge has booted Yellowstone Mountain Club LLC's reorganization plan back to bankruptcy court, ruling that the plan's liability release provisions are too broad and that the bankruptcy judge improperly greenlighted the plan, which calls for the company's sale, without giving interested parties a chance to object.

Judge Sam E. Haddon reversed and remanded the plan's confirmation in the U.S. District Court for the District of Montana on Tuesday, granting the luxury ski and golf club's co-founder Timothy Blixseth a win in his bankruptcy appeal....
