Pharmacy's Provigil Action To Remain In Federal Court

Law360, New York (November 5, 2010, 1:09 PM EDT) -- A federal judge has rejected Jabo's Pharmacy Inc.'s bid to remand to state court its lawsuit accusing Cephalon Inc. and generic-drug makers including Barr Pharmaceuticals Inc. of conspiring to keep a generic version of narcolepsy drug Provigil off the market.

In an order filed Thursday, Judge Mitchell S. Goldberg of the U.S. District Court for the Eastern District of Pennsylvania ruled that the amount in controversy exceeded the $5 million minimum for a class action to be heard in federal court, despite Jabo's assertions otherwise....
