9th Circ. To Consider Class Cert. In Aerotek OT Case

Law360, New York (November 11, 2010, 3:19 PM EST) -- A federal appeals court has agreed to weigh in on a lower court's decision not to certify a class of recruiters from employment recruiting firm Aerotek Inc. who claim they were misclassified as exempt from overtime pay requirements.

The U.S Court of Appeals for the Ninth Circuit on Monday granted the plaintiffs' petition for permission to appeal a district court's order denying their bid to certify a class of all individuals employed by Aerotek as recruiters in California from August 2004.
