Judge Tosses IBM Record-Keeping Class Action

Law360, New York (November 11, 2010, 2:03 PM EST) -- A federal judge has chucked a proposed class action alleging IBM Corp. failed to comply with employee record-keeping laws, but she gave the former worker bringing the case a chance to fix the complaint.

Judge Marilyn Patel of the U.S. District Court for the Northern District of California on Monday dismissed without prejudice the class claims relating to record-keeping as well as the plaintiff’s individual claims alleging IBM shortchanged him on the commission he was owed.
