Pentagon Capital Loses Brady, Giglio Bid In SEC Suit

Law360, New York (November 15, 2010, 12:46 PM EST) -- A federal judge has rejected Pentagon Capital Management PLC's bid to force the U.S. Securities and Exchange Commission to turn over all exculpatory evidence in the regulator's suit accusing the Pentagon of reaping $62 million through a deceptive market-timing scheme.

In an opinion issued Friday, Judge Robert W. Sweet of the U.S. District Court for the Southern District of New York said there was no basis for extending the Brady and Giglio requirements normally found in criminal proceedings brought by the government to the present civil...
