Fed. Circ. Resurrects FCRA Suit Over PACER Receipt

Law360, New York (November 16, 2010, 4:35 PM EST) -- A federal appeals court on Tuesday revived a class action brought against the U.S. government by an attorney who claims his credit card expiration date illegally ended up on an online receipt after he signed up for PACER.

Attorney James X. Bormes has a right to bring a suit against the government under the Fair Credit Reporting Act, a three-judge panel of the U.S. Court of Appeals for the Federal Circuit said, overturning a lower court decision.
