9th Circ. Denies Calif. Newspaper Class Cert. Appeal

Law360, New York (November 17, 2010, 1:31 PM EST) -- A federal appeals court has certified a class in a case brought against San Diego's North County Times by its deliverymen, despite one judge's objection that the potential $18 million in damages could sound the paper's death knell.

In a 2-1 split, a panel of the U.S. Court of Appeals for the Ninth Circuit on Tuesday decided not to hear the paper's appeal of a lower court decision to certify a class of about 800 newspaper carriers who claim they were wrongly classsified as independent contractors....
