Victoria's Secret FLSA Action Wins Initial Cert.

Law360, New York (November 17, 2010, 4:49 PM EST) -- A federal judge has granted conditional collective certification to a lawsuit alleging Victoria's Secret Direct LLC violated the federal Fair Labor Standards Act and New York labor law for not paying overtime to executive assistants.

Judge William H. Pauley III of the U.S. District Court for the Southern District of New York issued the ruling Tuesday. He also denied a motion for partial summary judgment by Victoria's Secret, which sought to dismiss the FLSA collective action and New York law class action claims.
