9th Circ. Affirms Dismissal Of Cumbre Broker Bid Suit

Law360, New York (November 18, 2010, 6:20 PM EST) -- A federal appeals court has upheld the dismissal of Cumbre Inc.’s suit alleging the State Compensation Insurance Fund improperly denied the company’s application seeking a contract to be a broker for the California agency.

The U.S. Court of Appeals for the Ninth Circuit on Wednesday ruled that a federal court correctly determined that Cumbre’s case was barred because it had already alleged the same breach of contract violation in state court.
