Franchisee Action Over BK Bargain Burgers Tossed

Law360, New York (November 22, 2010, 4:47 PM EST) -- Burger King Corp. has prevailed against a franchisee class action alleging the company’s pocket-friendly pricing for double cheeseburgers and Buck Double burgers violated franchise contracts.

On Friday, Judge K. Michael Moore of the U.S. District Court for the Southern District of Florida dismissed allegations that Burger King acted in bad faith when it instituted the bargain prices because the burgers cost more to produce and sell, and otherwise rejected the plaintiffs’ claims for contractual breaches.
