9th Circ. Nixes Ex-Cop's FLSA Training-Payback Action

Law360, New York (November 19, 2010, 6:41 PM EST) -- A federal appeals court on Friday upheld the dismissal of a proposed Fair Labor Standards Act class action brought by a woman who challenged an Oakland, Calif., policy requiring city cops to repay a portion of their training costs if they voluntarily leave the job before five years.

Plaintiff Courtney Gordon’s proposed action failed to bring a cognizable claim under the federal law, a three-judge panel in the U.S. Court of Appeals for the Ninth Circuit ruled in a published opinion.
