Pharmaceutical Holdings Admits Infringement In Deal

Law360 (March 22, 2007, 12:00 AM EDT) -- Adams Respiratory Therapeutics Inc. has reached a settlement in its patent infringement lawsuit against two subsidiaries of Pharmaceutical Holdings Corp. over the popular anti-congestion drug Mucinex, the company announced Wednesday.

Under the settlement, Pharmaceutical Holdings admitted that the patent in suit is valid, enforceable and infringed by the companies' generic extended-release products based on guaifenesin, the active ingredient in the drug.

The defendants, Mutual Pharmaceutical Co. and United Research Laboratories Inc., were sued by Adams in the U.S. District Court for the Eastern District of Pennsylvania...
