Army Wins Partial Toss Of Energy Bar Suit

Law360, New York (November 22, 2010, 7:35 PM EST) -- A federal judge has whittled down a more than $3 million breach of contract case brought by D'Andrea Brothers LLC against the U.S. government over the rights to produce a “Hooah”-branded energy bar.

Judge Nancy B. Firestone of the U.S. Court of Federal Claims granted the government summary judgment, shooting down D'Andrea's breach of contract claim and a claim that the government breached the implied covenant of good faith and fair dealing.
