Philly Judge Nixes GSK Paxil Birth Defect Suit

Law360, New York (November 23, 2010, 7:35 PM EST) -- A Philadelphia judge has dismissed a suit claiming that a baby was born with a heart defect because of her mother's Paxil use, ruling that the death of the prescribing physician made it impossible for the plaintiffs to prove the case against GlaxoSmithKline.

Judge Gary S. Glazer of the Philadelphia Court of Common Pleas dismissed a suit brought by Marsha and Denis Blyth over their daughter's heart defect Monday, ending a 10-day jury trial in the failure-to-warn action.
