DOJ Fights Win For Lesbian Nurse In DADT Case

Law360, New York (November 24, 2010, 6:18 PM EST) -- The U.S. Department of Justice is appealing a judge's decision to reinstate an openly gay flight nurse to the U.S. Air Force after finding the government's "don't ask, don't tell" policy damaged morale, unit cohesion and military readiness.

The DOJ filed its notice of appeal on Tuesday in the U.S. Court of Appeals for the Ninth Circuit, two months after Judge Ronald B. Leighton of the U.S. District Court for the Western District of Washington ruled that Maj. Margaret Witt's discharge hurt the military.
