High Court Won't Hear Tiffany IP Claims Against EBay

Law360, New York (November 29, 2010, 1:45 PM EST) -- The U.S. Supreme Court has elected not to hear an appeal from Tiffany & Co. in a trademark dispute with eBay Inc., effectively ending a six-year court battle over the sale of counterfeit Tiffany jewelry on the online auctioneer's website.

The high court denied Tiffany's petition for a writ of certiorari without comment on Monday, upholding rulings by two lower courts that eBay was not responsible for preemptively policing its site for possible fraud.
