Fifth Third To Settle Overdraft Suit For $9.5M

Law360, New York (December 2, 2010, 3:47 PM EST) -- Fifth Third Bank has struck a deal to pay $9.5 million to resolve all claims in a class action alleging the bank improperly charged overdraft fees on ATM withdrawals and debit card transactions.

Judge Robert M. Dow Jr. of the U.S. District Court for the Northern District of Illinois on Monday authorized notice to be sent out to all prospective members of the proposed settlement class.

The court will hold a hearing on March 16 to decide whether to give final approval to the settlement, so...
