Judge Tosses Part Of Ex-Wyeth Exec's Firing Suit

Law360, New York (December 3, 2010, 2:48 PM EST) -- A federal judge has dismissed part of a $17 million lawsuit brought by an ex-Wyeth Pharmaceuticals Inc. executive who claimed he was mistreated and ultimately fired after pointing out flaws in drug testing data.

Teofil Boata, the former assistant director of statistical programming in Wyeth's vaccine division, has no right to bring a private action under the Food Drug and Cosmetic Act, Judge Denise Cote of the U.S. District Court for the Southern District of New York said Wednesday in a court ruling.
