Cigna Wins Toss Of Disability Plan Class Action

Law360, New York (December 6, 2010, 2:12 PM EST) -- A federal judge has thrown out a proposed class action by a former Schering-Plough Corp. employee accusing Cigna Corp., Unum Group and Schering of fraud related to the denial of health benefits.

Judge Dennis M. Cavanaugh of the U.S. District Court for the District of New Jersey ruled Friday that John N. Bukuvalas' claims against the insurers are preempted by the Employee Retirement Income Security Act and dismissed them with prejudice.
