DC Circ. Backs Calif. Plan To Merge Utility Districts

Law360 (December 10, 2010, 6:20 PM EST) -- A federal appeals court has denied requests by several municipal utility districts in California to review the Federal Energy Regulatory Commission's approval of a plan to combine two utility districts for the purposes of pricing transactions.

In a decision Friday, the U.S. Court of Appeals for the District of Columbia Circuit ruled that the utilities did not prove that FERC's approval of the plan was outside its jurisdiction or that the plan was discriminatory.
