Facebook Wins Partial Toss Of Click Fraud Class Suit

Law360, New York (December 16, 2010, 5:35 PM EST) -- A federal judge has tossed third-party click fraud claims brought against Facebook Inc. by advertisers who claim the social networking giant employs an insufficient click-filtering system.

Judge Jeremy Fogel of the U.S. District Court for the Northern District of California dismissed the advertisers' second amended complaint Wednesday with respect to a click-fraud claim under the California Unfair Competition Law's so-called "fraud prong," but allowed leave to amend.

The judge's decision only applies to fraud claims, according to plaintiffs' attorney Jonathan Shub of Seeger Weiss LLP. The...
