BLR Loses 2nd Bid To Nix Negative Air Force Review

Law360, New York (December 17, 2010, 6:24 PM EST) -- A federal judge has tossed for the second time a protest by BLR Group of America Inc. seeking to void a negative and allegedly inaccurate performance review the company received from the U.S. Air Force after a contract was terminated.

BLR failed to properly notify the Air Force that it was seeking redress under the 1978 Contract Disputes Act, so the court now lacks jurisdiction to hear the company’s complaint, according to Thursday’s opinion from Judge Margaret M. Sweeney of the U.S. Court of Federal Claims....
