Staff Atty, OPM Battle Over Same-Sex Spouse Benefits

Law360, New York (December 17, 2010, 10:57 PM EST) -- A federal judge on Friday agreed to hear an appeals court staff attorney's lawsuit alleging the U.S. Office of Personnel Management illegally blocked her from listing her same-sex spouse on her health plan, a proceeding the plaintiff's lawyer described as encouraging.

Judge Jeffrey S. White of the U.S. District Court for the Northern District of California did not immediately issue a ruling after Friday's oral arguments. Instead, he took the plaintiff's motion for an injunction and OPM's motion to dismiss under advisement.
