Wyeth Loses Bid To Take Novartis IP Suit To Calif.

Law360 (December 21, 2010, 1:20 PM EST) -- A federal appeals court has denied a motion by Wyeth to move a patent infringement suit filed against the drugmaker by competitor Novartis AG from Texas to California, saying the request came too late and would waste the time of both courts.

Wyeth also failed to make a convincing argument that its delay was excusable, Judge Timothy Dyk wrote Monday for a three-judge panel of the U.S. Court of Appeals for the Federal Circuit.
