Insurer Wants Off Hook For Lubrizol Cleanup

Law360 (December 21, 2010, 8:23 PM EST) -- Arrowood Indemnity Co. has launched a suit against Lubrizol Corp. claiming it should not be held liable for coverage of cleanup costs at a Texas Superfund site, including $2.4 million in expenses already incurred, because the contamination does not constitute an occurrence under an insurance policy.

The insurer has refused to cover the environmental damage resulting from Lubrizol's "regular, intentional and nonaccidental" discharge, disposal and release of hazardous substances at Patrick Bayou because the insurance policy only covered accidental destruction of "tangible property," according to a complaint filed Monday in the...
