Judge Tosses Suit Over Topps Meat Recall

Law360 (December 22, 2010, 4:41 PM EST) -- A federal judge has dismissed a suit filed by 12 plaintiffs allegedly sickened by E. coli-contaminated meat distributed by now-defunct Topps Meat Co. LLC, ruling that the case can't be brought under the Magnuson-Moss Act.

Judge Colleen Kollar-Kotelly of the U.S. District Court for the District of Columbia on Tuesday dismissed the suit without prejudice for lack of subject matter jurisdiction, saying the plaintiffs' claims did not meet any of the three exceptions that allow personal injury cases to be tried under the act.
