Judge Says Flight Attendants Can Sue Delta

Law360, New York (December 22, 2010, 7:33 PM EST) -- A federal judge has cleared the way for a suit challenging Delta Air Lines Inc.’s plan to integrate its flight attendants with those from Northwest Airlines Inc., which it acquired in 2008, rejecting Delta's argument that the suit is really a labor representation fight that belongs before the National Mediation Board.

The conflict over how to determine seniority among the newly integrated flight attendants may be a “representation issue,” a “catchall phrase” that Delta peppers throughout its dismissal motion, but it is not a “representation dispute,”...
