Home Depot Worker Bias Suit Remains In Federal Court

Law360, New York (January 3, 2011, 6:00 PM EST) -- Following a decision to deny class certification, a federal judge has refused to send an employment discrimination suit against The Home Depot USA Inc. back to New Jersey court on jurisdictional grounds.

In a Thursday order denying the remand motion, Judge Dennis Cavanaugh of the U.S. District Court for the District of New Jersey said that previous court filings, including a demand for $25 million, supported the conclusion that the five remaining plaintiffs could potentially win damages of $75,000, which would be enough to keep the...
