Tyco Escapes Calif. Labor Class Action

Law360, New York (January 10, 2011, 1:48 PM EST) -- A federal judge has tossed a proposed class action accusing Tyco Electronics Corp. of skimping on overtime pay and meal and rest breaks, saying the lead plaintiff's own testimony contradicted his allegations.

Anthony Villa, who spent two months as an electrician for Tyco before being fired in December 2008, testified that he never missed a meal or rest break, according to an opinion signed Friday by Judge Marilyn Hall Patel of the U.S. District Court for the Northern District of California.
