7th Circ. Nixes WARN Action Against DHL

Law360 (January 11, 2011, 3:34 PM EST) -- The Seventh Circuit refused Tuesday to revive a proposed class action claiming DHL Express Inc. violated the Worker Adjustment and Retraining Notification Act when it decided to drop its U.S. domestic shipping services and close five Chicago-area facilities.

A three-judge panel for the U.S. Court of Appeals for the Seventh Circuit affirmed a lower court's 2009 decision to grant summary judgment to DHL after determining that the circumstances of the layoffs did not trigger protections under WARN.
