Navy Was Right To Reject Dairy Farm Bid, Judge Says

Law360 (January 11, 2011, 6:43 PM EST) -- The U.S. Department of the Navy was right to dismiss a bid on a dairy farm lease because the bid called for the mining of sand and gravel on the property, a federal judge ruled Tuesday.

Judge Susan G. Braden of the U.S. Court of Federal Claims found that the Navy had correctly determined that the sand-and-gravel bid amounted to a removal of real property from the farm, which was precluded under the Federal Property Act and federal statutes governing the Navy and the farm....
