Guardian Cleaners Win Class Cert. In Overtime Suit

Law360, New York (January 14, 2011, 6:37 PM EST) -- A federal judge has granted preliminary certification for a class of cleaners in an overtime suit, dismissing their employer Guardian Services Industries Inc.'s arguments to deny certification because the proposed class included union members.

Judge Colleen McMahon of the U.S. District Court for the Southern District of New York issued an order Thursday granting preliminary certification, saying that workers — union or not — were entitled to overtime pay under the Fair Labor Standards Act if they worked more than 40 hours in a week....
