Guards Lose Challenge To Calif. Prison Furlough Plan

Law360 (January 18, 2011, 12:04 PM EST) -- In the latest ruling on California's mandatory furloughs, a federal judge has thrown out a collective action brought by state prison guards who alleged the program violated the Fair Labor Standards Act.

Judge Vaughn R. Walker of the U.S. District Court for the Northern District of California issued the ruling Friday, granting the state's motion for summary judgment. He rejected the plaintiffs' claims that the state is violating the FLSA by forcing them to work furlough days without pay.
