GAO Downs Protest Over Home Care Contract Terms

Law360 (January 24, 2011, 1:59 PM EST) -- The U.S. Government Accountability Office has denied a protest by B&B Medical Services Inc. and Rotech Healthcare Inc. over the adverse terms of a contract to provide home oxygen supplies and services to veterans.

In a ruling issued Friday, the GAO found that the U.S. Department of Veterans Affairs was not required to limit its contract for home oxygen equipment rental and services to non-manufacturers or evaluate candidates according to the number of employees, effectively excluding B&B and Rotech from contention.
