Fox News Program Wards Off Preliminary Injunction

Law360 (April 9, 2007, 12:00 AM EDT) -- Fox News Network LLC’s new “Red Eye” late night television program will keep its name, at least for now, after a federal judge denied Tribune Co.’s motion for a preliminary injunction.

Last Wednesday, Judge Elaine E. Bucklo of the U.S. District Court in Chicago ruled that media conglomerate Tribune Co. had shown only that it might prevail in the trademark infringement lawsuit and that the balance of harm favored Fox.
