5th Circ. Affirms Dismissal Of Stryker Prosthetic Suit

Law360, New York (January 25, 2011, 4:40 PM EST) -- The Fifth Circuit on Tuesday affirmed the dismissal of a prosthetic hip owner's defective manufacturing claim against Stryker Corp. and refused to hear new arguments about why other claims should not be preempted by federal law.

Texas resident Ronald Funk's claim that his Trident System hip was improperly made fell short of established pleading standards, a three-judge panel on the U.S. Court of Appeals for the Fifth Circuit affirmed.
