1st Circ. Asked To Nix Lower Award In File-Sharing Suit

Law360 (January 27, 2011, 4:29 PM EST) -- The U.S. government has asked the First Circuit to vacate a lower court's decision to trim the damages imposed on a file-sharing software user from $675,000 to $67,500 in a copyright suit brought by Sony BMG Music Entertainment.

The U.S. District Court for the District of Massachusetts erred by tackling the issue of the amount of damages imposed on Joel Tenenbaum from a constitutional standpoint, the U.S. Department of Justice said in a brief filed Wednesday in the U.S. Court of Appeals for the First Circuit....
