9th Circ. Returns 160 Plaintiffs To Toxic Tort Suit

Law360, New York (January 27, 2011, 8:09 PM EST) -- The Ninth Circuit has reinstated the claims of 160 residents of a California town who say they are suffering from health problems because of exposure to contamination from a hard chrome plating facility.

In a published opinion issued Thursday, the majority of a three-judge U.S. Court of Appeals for the Ninth Circuit panel ruled that the district court improperly dismissed those plaintiffs from toxic tort actions against companies tied to the facility on statute of limitations grounds.
