Judge Denies Actus Quick Win In Contractor Dispute

Law360, New York (January 31, 2011, 2:59 PM EST) -- A federal judge has denied partial summary judgment to Actus Lend Lease LLC, which claimed a subcontractor had no grounds to sue for damages over a federally funded military base construction project, and had already recovered damages from another source.

Actus also claimed the subcontractor, plaintiff Contracting Management Inc., had voluntarily abandoned the project, and therefore had no grounds to recover payment under the contract terms, according to Judge Neal P. McCurn’s order Friday in the U.S. District Court for the Northern District of New York....
