Direct Purchasers' Plavix Antitrust Actions Tossed

Law360 (February 1, 2011, 1:58 PM EST) -- A federal judge has thrown out several proposed class actions brought by indirect purchasers alleging Sanofi-Aventis SA and Bristol-Myers Squibb Co. conspired with Apotex Corp. to keep a generic version of the blood thinner Plavix off the market.

Judge Michael Watson of the U.S. District Court for the Southern District of Ohio on Monday granted the drugmakers' motion to dismiss, holding that the plaintiffs failed to allege an injury under the antitrust laws.
