Coverage Battle Over $150M Asphalt Verdict Heats Up

Law360, New York (February 1, 2011, 2:59 PM EST) -- Engineering company Applied Technical Services Inc. is seeking to dismiss a lawsuit brought by an insurer that wants to escape coverage for a $150 million judgment against the company, which was found liable for faulty testing of highway asphalt.

ATS filed its motion to dismiss Monday in the U.S. District Court for the Northern District of Georgia, saying ATS' insurer, Atlantic Specialty Insurance Co., lacks standing to bring the case because there is no controversy between the parties.
