Conglas Loses Cert. Bid Against Gemini Insurance

Law360, New York (February 7, 2011, 5:24 PM EST) -- Consolidated Fiberglass Products Co. has lost its bid for class certification in a lawsuit accusing Gemini Insurance Co. of demanding deductibles to which it was not entitled.

Judge Marilyn Huff of the U.S. District Court for the Southern District of California rejected Conglas' motion for class certification Friday after finding that common issues of law and fact did not predominate with regard to the plaintiff's breach of contract, breach of the covenant of good faith and fair dealing, and declaratory relief claims.
