GAO Kills Herve Cody's Army Spillway Contract Fight

Law360, New York (February 7, 2011, 7:21 PM EST) -- The U.S. Government Accountability Office has denied Herve Cody Contractor Inc.'s protest over a U.S. Army contract to replace spillways on the Atlantic Intracoastal Waterway, finding that the agency reasonably rejected the protester's corporate experience as unacceptable.

In a Jan. 26 decision unsealed Monday, the GAO determined that the Army had properly cut the Robbinsville, N.C.-based Herve Cody out of the running because the contractor had not submitted three examples of projects that were similar in scope to the requested work, as the solicitation required....
