Judge Tosses Vioxx Securities Suit

Law360 (April 13, 2007, 12:00 AM EDT) -- Driving a stake into the heart of a securities lawsuit against Merck & Co., a federal judge on Thursday dismissed with prejudice shareholders’ claims that the pharmaceutical giant defrauded investors by covering up health risks associated with painkiller Vioxx.

U.S. District Judge Stanley R. Chesler said in an opinion filed Thursday in the U.S. District Court for the District of New Jersey that the long-running class action case should be tossed because all of the plaintiffs' claims were time-barred under the applicable statutes of limitations....
