7th Circ. Revives Chiropractor's FCA Suit

Law360, New York (February 18, 2011, 6:35 PM EST) -- The Seventh Circuit has revived a chiropractor's False Claims Act suit that a federal judge in Illinois had dismissed after finding that the plaintiff was not the original source of information detailing her employer's alleged Medicaid and Medicare fraud.

While not ruling on the merits of the suit itself, the U.S. Court of Appeals for the Seventh Circuit said the reports cited by the defendants as the original source of the allegations pertain to fraud in the chiropractic industry as a whole, not at the defendants'...
